Personal Injury: Car Accident

After a motor vehicle accident, you typically have two kinds of damages: property damages; and personal injury damages.

An automobile accident is always a stressful situation, and insurance companies know this.  When you are involved in an auto accident that is not your fault, the fault driver’s insurance company will often try to get you to settle all of your claims, both to property damage and personal injuries, at the time you resolve your property damage claims.  It is usually a bad idea to sign such a release without consulting with an attorney first.  Property damage claims can be resolved separately from your personal injury claims, and you should always wait until after you have consulted both a physician and your attorney before you sign any release relating to your personal injury claims.

In all personal injury cases, including motor vehicle accidents, you are entitled to recovery general damages for your pain, suffering, and emotional distress.  You are also entitled to recover special damages, which include any medical bills, wage loss, and other out-of-pocket expenses arising as a result of the auto accident.
